Important: ThePicksHouse mainly sells goods made to the customer's specifications or clearly personalised.
For such products, the statutory right of withdrawal normally applicable to distance purchases does not apply.
This does not affect the customer's statutory rights where a product is defective or does not conform to the sales contract.

2. Scope and applicable consumer rights
These Terms & Conditions govern purchases made through ThePicksHouse.com and its localised versions.
By placing an order, the customer confirms that they have had the opportunity to read these Terms before completing the purchase.
Nothing in these Terms excludes or limits mandatory rights granted to consumers by applicable Italian or European Union law.
Where a customer purchases for purposes related to a trade, business, craft or profession, consumer-specific protections apply
only where required by law.
3. Personalised and made-to-order products
ThePicksHouse specialises in personalised and made-to-order products, including custom guitar picks, drumheads, reusable drumhead
skins/stickers, drumsticks, apparel, accessories and other printed merchandise.
A product is considered personalised when it is manufactured, printed, configured or modified according to artwork, text, logos,
colours, dimensions, product options or other specifications selected or supplied by the customer.
4. Product representation, materials and manufacturing tolerances
Product photographs, digital previews and on-screen colours are intended to provide a reasonable representation of the finished
product. Exact reproduction cannot always be guaranteed because screens, inks, printing technologies, substrates, coatings,
materials and production batches may differ.
Minor variations in colour, position, print density, gloss, texture, edge coverage, dimensions, thickness, shape or surface finish
that are compatible with the selected material and production process do not in themselves constitute a lack of conformity.
Products manufactured by third-party brands may also have normal manufacturing tolerances or base markings, textures, logos and
surface characteristics introduced by the original manufacturer.
5. Special characteristics of printed guitar picks
Guitar picks are functional objects subject to friction, impact and wear during normal use. Printed areas may therefore show wear,
scratching, fading or chipping over time, especially at the edges or on areas that come into contact with strings.
Normal wear caused by use is not a production defect.
On some branded or pre-printed picks, including certain Dunlop models, original manufacturer's markings may already be present on
one or both sides. Where necessary to obtain adequate coverage, hide existing markings or achieve an acceptable visual result,
ThePicksHouse may need to print a larger area or the full printable surface rather than only the customer's graphic.
Full-surface printing, white underprint, primers, multiple ink layers or other technically necessary print processes may create a
perceptible difference in texture, gloss, colour or feel compared with an unprinted side or with another pick model/material.
Such differences are not in themselves a defect where they result from the necessary printing process and the product otherwise
conforms to the agreed order.
Different pick materials, colours and finishes may react differently to the same artwork and ink system. A graphic that produces
one result on a particular material, thickness or colour may produce a somewhat different result on another.
6. Artwork supplied by the customer
The customer is responsible for checking the accuracy, quality, spelling, orientation, resolution, dimensions, colours and content
of artwork, text, logos and other files supplied for production.
Very small text, thin lines, low-resolution images, transparencies, gradients, fine details or colours close to the underlying
product colour may not reproduce exactly as they appear on screen. ThePicksHouse may contact the customer where a file presents
obvious technical issues, but is not required to identify every possible design or print limitation.
Where a digital proof, mock-up or preview is provided for approval, production may be based on the approved version.
The preview is intended primarily to show content, approximate placement and proportions and is not a colour-calibrated contract proof
unless expressly agreed otherwise in writing.
The customer confirms that they own, or have permission to use, all intellectual property contained in files submitted to
ThePicksHouse and authorises ThePicksHouse to use those files to fulfil the order.
7. Reusable drumhead skins, adhesive products and application
Some drumhead skins and similar products use removable or repositionable adhesive technologies designed for application to suitable,
clean and smooth surfaces. Their performance depends on correct application and on the condition of the surface.
Before application, the customer must ensure that the target surface is clean, dry and free from dust, grease, silicone,
cleaning residues, waxes or other contaminants. The material should be applied progressively and firmly in accordance with any
instructions supplied with the product.
Air pockets, incomplete contact, lifting or poor adhesion caused by incorrect application, contaminated or unsuitable surfaces,
excessive stretching, creases, repeated handling, incorrect storage, environmental conditions or failure to follow application
instructions do not constitute a production defect.
If an adhesion problem is reported, ThePicksHouse may reasonably ask the customer for photographs, video and information about the
application method and surface preparation in order to determine the cause before authorising a replacement or refund.
8. Orders and acceptance
An order submitted through the website constitutes an offer to purchase. The order is accepted when ThePicksHouse confirms it,
begins production, or otherwise communicates acceptance to the customer.
ThePicksHouse may contact the customer if artwork, specifications, stock availability, shipping details or other information is
incomplete or requires clarification. Production and delivery times may be suspended while awaiting the customer's reply.
ThePicksHouse may refuse or cancel an order where fulfilment is impossible, unlawful, technically impracticable, affected by an
obvious pricing error, or where necessary information is not supplied. Amounts that must be refunded will be returned using an
appropriate payment method.
9. Prices and payment
Prices displayed on the website are those applicable when the order is placed. Applicable taxes and shipping charges are shown
during checkout according to destination and customer status.
For shipments to destinations where import formalities apply, customs duties, import VAT, brokerage fees and other charges imposed
by destination authorities or carriers may be payable by the recipient unless expressly stated otherwise at checkout.
Available payment methods are those shown during checkout.
10. Production times
Production times shown on product pages or during checkout are estimates unless a specific deadline has been expressly accepted by
ThePicksHouse in writing. Times may vary depending on product type, quantity, artwork approval, availability of materials,
production workload, public holidays, seasonal closures and circumstances beyond ThePicksHouse's reasonable control.
Customers ordering for a specific concert, event or deadline should contact ThePicksHouse before ordering if delivery by that date
is essential. An estimated delivery date is not a guaranteed delivery date unless expressly confirmed as such in writing.
11. Shipping and delivery
Orders are shipped to the delivery address provided by the customer. The customer is responsible for providing complete and accurate
delivery information and for ensuring that the recipient can accept delivery.
Delivery estimates provided by ThePicksHouse or a carrier are indicative unless a guaranteed service has expressly been purchased.
Delays caused by carriers, customs authorities, incorrect addresses, failed delivery attempts, force majeure or other circumstances
outside ThePicksHouse's reasonable control may affect delivery times.
Customers should inspect parcels upon delivery and promptly notify ThePicksHouse of visible transport damage, missing items or
apparent problems, preferably supplying photographs of the external packaging, internal packaging and products.
This request does not limit statutory consumer rights.
12. Right of withdrawal for personalised products
The statutory right of withdrawal applicable to many distance purchases does not apply to goods made to the consumer's specifications
or clearly personalised.
Accordingly, personalised products produced using the customer's artwork, text, logo, configuration or other individual
specifications cannot normally be returned simply because the customer changes their mind, no longer needs the item, or dislikes
a characteristic that conforms to the product description and agreed specification.
This exclusion does not affect statutory rights where the goods are defective or otherwise non-conforming.
13. Withdrawal for eligible non-personalised products
Where a consumer purchases a non-personalised product for which the statutory right of withdrawal applies, the consumer may exercise
that right within the period provided by applicable law.
The consumer must inform ThePicksHouse of the decision to withdraw by an unequivocal statement and return the goods within the
applicable legal period.
The direct cost of returning goods following a statutory withdrawal is borne by the customer, unless ThePicksHouse
expressly agrees to bear it or applicable law provides otherwise. We recommend using a tracked shipping service.
The customer may be responsible for diminished value resulting from handling beyond what is necessary to establish the nature,
characteristics and functioning of the goods, to the extent provided by law.
14. Voluntary returns and goodwill returns
ThePicksHouse may, at its discretion, agree to accept a return even where no statutory right of withdrawal exists, including
personalised goods that are not defective or non-conforming. Such acceptance is a voluntary commercial gesture and does not create
a general right to return personalised products.
Unless ThePicksHouse expressly agrees otherwise in writing, the customer is responsible for arranging and paying all return
shipping costs for a voluntary or goodwill return.
ThePicksHouse does not provide a prepaid return label for such returns unless expressly agreed. We strongly recommend a tracked
shipping service. The customer remains responsible for the return parcel until it is delivered to ThePicksHouse.
Original outbound shipping charges are not automatically refundable in a voluntary return and will be handled according to the
specific agreement made with the customer and any mandatory legal requirements.
Products should not be returned before contacting customer service and receiving return instructions.
15. Legal guarantee of conformity
Consumers benefit from the legal guarantee of conformity provided by applicable consumer law. The seller is responsible for lack of
conformity under the conditions and within the periods established by law.
If a product appears defective or non-conforming, the customer should contact
support@thepickshouse.com and provide the order number, a description of the problem
and, where reasonably possible, photographs or video that allow ThePicksHouse to assess the issue.
Where a lack of conformity is established, the consumer is entitled to the remedies provided by applicable law, which may include
repair or replacement and, where the legal requirements are met, price reduction or termination/refund.
Statutory remedies for a confirmed lack of conformity are provided without charge to the consumer.
Where ThePicksHouse requires a defective or non-conforming product to be returned in connection with a statutory guarantee claim,
the necessary return costs will be borne by ThePicksHouse as required by law.
Customers should not send allegedly defective goods back before receiving return instructions, because photographic/video evidence,
troubleshooting, replacement or another solution may make a physical return unnecessary.
16. Assessment of complaints and non-defect situations
Before authorising a remedy, ThePicksHouse may reasonably assess whether the reported issue is a production defect, transport damage,
normal wear, artwork-related limitation, characteristic of the selected material or print method, incorrect application/use, or
another circumstance.
A difference in texture, gloss, colour rendition, ink coverage, feel or print method is not automatically a defect where it is
inherent in, or reasonably necessary for, the selected material, colour, branded base product or production process and the finished
product otherwise conforms to the order.
Normal wear occurring after use, including wear to the printed surface of guitar picks caused by contact with strings, does not
constitute a lack of conformity unless the circumstances indicate an underlying defect that existed at delivery.
17. Replacement products
Where ThePicksHouse agrees to remake or replace a product, the replacement will normally be produced according to the original order
specifications. Any requested change of model, colour, thickness, artwork or configuration is subject to availability and technical
feasibility and must be expressly agreed by ThePicksHouse.
A voluntary replacement or goodwill gesture does not constitute an admission that the original product was legally non-conforming.
18. Cancellations and changes after ordering
Personalised products may enter preparation or production shortly after an order is placed. Requests to cancel or change an order
are therefore not guaranteed.
If a cancellation or modification is requested before personalised production has started, ThePicksHouse will make reasonable
efforts to accommodate the request. Once production has started, cancellation or changes may be impossible or may involve costs
already incurred, subject always to mandatory consumer rights.
19. Incorrect customer information
The customer is responsible for the accuracy of names, addresses, email addresses, tax details, artwork, product options, quantities
and other information supplied when ordering.
Additional shipping or production costs caused by incorrect or incomplete information supplied by the customer may be charged to
the customer to the extent permitted by law.
20. Intellectual property and customer content
Unless otherwise stated, website content, graphics, text, photographs, layouts, software, trademarks and other materials belonging
to ThePicksHouse are protected by applicable intellectual property laws and may not be reproduced or commercially used without
permission.
Customer-provided artwork remains the property of its respective owner. By submitting artwork, the customer grants ThePicksHouse
the limited rights necessary to review files, process the order, manufacture the products and provide related customer service.
The customer must not submit unlawful content or content that infringes third-party copyright, trademark or other rights.
21. Privacy
Personal data is processed in accordance with our current
Privacy Policy.
22. Liability and force majeure
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
Subject to mandatory consumer rights, ThePicksHouse is not responsible for failure or delay caused by circumstances beyond its
reasonable control, including carrier disruptions, customs delays, natural events, fires, strikes, infrastructure outages,
government measures, supply interruptions or comparable events.
23. Governing law and disputes
These Terms are governed by Italian law, without depriving consumers resident in another country of mandatory protections that
apply to them under European Union rules.
Consumers may have access to applicable alternative dispute resolution (ADR) procedures. Customers are encouraged to contact
ThePicksHouse customer service first so that an attempt can be made to resolve any dispute directly.
For disputes involving consumers, jurisdiction is determined by mandatory consumer-protection rules. For transactions with business
or professional customers, jurisdiction shall be determined according to applicable law and any valid agreement between the parties.
24. Changes to these Terms
ThePicksHouse may update these Terms & Conditions from time to time. The version applicable to an order is the version made
available at the time the order is placed, unless a later change is required by mandatory law or is expressly accepted by the customer.
